By accessing or using the Nexkora website, software, pilot program, or related services, you agree to these Terms of Use. If you are using Nexkora on behalf of an organization, you represent that you are authorized to act for that organization.

Services

Nexkora provides software and related services intended to support alarm delivery, operational visibility, mobile actioning, connectivity, and related workflows. The service may evolve over time as the product matures, including updates to features, user experience, deployment options, and support practices.

Customer Responsibilities

Customers are responsible for proper configuration, validation, and operation of Nexkora within their own environment. This includes confirming that alarm rules, escalation paths, user permissions, connectivity, and deployment settings are appropriate for the customer's specific operational and regulatory context.

Acceptable Use

• You must not misuse the service, attempt unauthorized access, interfere with normal operation, or test the platform in a way that creates unnecessary risk.
• You must not upload or route content that violates applicable law, contractual restrictions, or the rights of others.
• You are responsible for maintaining the confidentiality of account credentials and limiting access to authorized users.

Pilot Program Terms

Any pilot, early access, or founding deployment may be offered on a limited basis. Pilot scope, support, pricing, availability, and feature sets may change as Nexkora develops. Pilot participation does not guarantee continued access to specific features, timelines, or commercial terms after the pilot period ends.

Important System Use Notice

Nexkora is not a replacement for primary life-safety systems, emergency shutdown systems, fire protection systems, or any other code-required protection or control systems. Customers remain responsible for maintaining compliant primary safety, control, and protection systems appropriate to their environment.

Intellectual Property

Nexkora, LLC and its licensors retain all rights, title, and interest in the Nexkora software, website, content, designs, and related intellectual property. Except for limited usage rights granted under applicable agreements, no ownership rights are transferred to customers or site visitors.

Disclaimers

Nexkora is provided on an as-available basis unless otherwise stated in a signed agreement. We work to provide reliable and useful software, but we cannot guarantee uninterrupted operation, complete compatibility with every environment, or suitability for every use case without customer-side validation.

Limitation of Liability

To the maximum extent permitted by law, Nexkora, LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or service. Operational environments vary significantly, and customers are responsible for validating deployment decisions and safeguards within their own infrastructure.

Termination

We may suspend or terminate access where necessary to protect the service, address misuse, comply with law, or respond to material breaches of these terms or applicable agreements. Customers may stop using the website or service at any time, subject to any contractual obligations in place.

Governing and General Terms

These Terms of Use are governed by the applicable law specified in a signed customer agreement or, where no separate agreement applies, by generally applicable law without limiting mandatory legal rights. If one provision is found unenforceable, the remaining provisions will continue in effect.
